About This Notice
This Notice describes how medical information about your child may be used and disclosed and how you can get access to this information. Please review it carefully.
Each therapist on the ViaThera platform is an independent Covered Entity under HIPAA and adopts this Notice of Privacy Practices template, which ViaThera LLC hosts on their behalf as a HIPAA Business Associate. Your specific therapist's name, discipline, and license number are provided at the time of service and in your Family Services Agreement.
1. Who This Notice Covers
This Notice applies to Protected Health Information (PHI) created, received, or maintained by your therapist in connection with therapy services delivered to your child through the ViaThera platform, including occupational therapy, physical therapy, and speech-language pathology services.
2. How We May Use and Disclose Your Child’s Health Information
2.1 Treatment
Your therapist uses your child's PHI to provide therapy services, including evaluation, treatment planning, session delivery, and documentation. Your therapist may share PHI with other healthcare providers involved in your child's care (such as your child's pediatrician or school-based therapist) as necessary to coordinate treatment. ViaThera's platform facilitates documentation, scheduling, and telehealth delivery as part of the treatment process.
2.2 Payment
Your therapist (through ViaThera as billing agent) may use and disclose your child's PHI to obtain payment for services, including submitting insurance and Medicaid claims, verifying coverage and eligibility, and collecting cost-sharing amounts. Claims are submitted under ViaThera's Group NPI through Office Ally.
2.3 Healthcare Operations
Your therapist and ViaThera may use your child's PHI for healthcare operations, including quality improvement, training, compliance activities, care transition coordination, and platform improvement. ViaThera's AI-assisted documentation tools (Deepgram for speech-to-text and Anthropic Claude for draft note generation) process session data as part of healthcare operations; all AI-generated content is reviewed and finalized by your therapist.
2.4 Other Permitted Uses and Disclosures
Your therapist may also use or disclose your child's PHI without your authorization in the following circumstances:
- As required by law, including responding to lawful court orders, subpoenas, or government investigations.
- To report suspected child abuse or neglect, or a credible threat of harm to the child or another person, as required by Colorado mandatory reporting laws.
- To prevent or lessen a serious and imminent threat to the health or safety of the child or another person.
- For public health activities as required or permitted by law.
- To the U.S. Department of Health and Human Services (HHS) for HIPAA compliance review.
2.5 Uses Requiring Your Authorization
Except as described above, your therapist will not use or disclose your child's PHI without your written authorization. This includes disclosures for marketing purposes and the sale of PHI. You may revoke your authorization at any time in writing, except to the extent that your therapist has already acted in reliance on it.
3. Your Rights Regarding Your Child’s Health Information
3.1 Right of Access
You have the right to inspect and obtain a copy of your child's PHI maintained in the ViaThera platform. To request access, contact your therapist through the Platform or email compliance@viathera.health. ViaThera will provide access within 30 days of a verified request.
3.2 Right to Amend
You have the right to request that your therapist amend PHI that you believe is incorrect or incomplete. Your therapist may deny the request if the information is accurate and complete. To request an amendment, contact your therapist through the Platform.
3.3 Right to an Accounting of Disclosures
You have the right to request a list of disclosures of your child's PHI made by your therapist or ViaThera, other than disclosures for treatment, payment, and healthcare operations. ViaThera maintains audit logs for a minimum of 6 years. To request an accounting, contact compliance@viathera.health.
3.4 Right to Request Restrictions
You have the right to request restrictions on how your child's PHI is used or disclosed. Your therapist will consider your request but is not required to agree. If your therapist agrees to a restriction, it will be honored except in emergency situations.
3.5 Right to Confidential Communications
You have the right to request that communications about your child's PHI be made in a specific way or at a specific location. Your therapist and ViaThera will accommodate reasonable requests.
3.6 Right to a Paper Copy of This Notice
You have the right to receive a paper copy of this Notice upon request. Contact compliance@viathera.health or ask your therapist through the Platform.
4. Therapist’s Duties
Your therapist is required by law to maintain the privacy of your child's PHI, to provide you with this Notice, and to follow the terms of the Notice currently in effect. Your therapist reserves the right to change the terms of this Notice and to make the new Notice applicable to all PHI maintained. Changes will be communicated through the ViaThera platform with at least 30 days' advance notice.
5. How to File a Complaint
If you believe your privacy rights have been violated, you may file a complaint with:
- Your Therapist: contact information is provided in your Family Services Agreement and on your therapist's profile within the Platform.

You will not be retaliated against for filing a complaint.
6. Effective Date
This Notice is effective as of June 3, 2026. It is provided on behalf of each independent therapist practicing through the ViaThera platform and is hosted by ViaThera LLC as Business Associate.
